I was wondering why is it that you have so many red dots and so disliked in IV and your response below answers that question. You are a mischief monger who want to mislead people. The issue was never about which is better eb1 or eb2 or eb3, the answer is eb1 is better than eb2 and eb2 is better than eb3. The issue is how easy is it to port to eb2, infact if porting to eb2 was that easy everybody would have already done that. nobody is sponsoring green cards in this economy not even eb3 forget about eb2, not even desi companies are sponsoring eb3 perm petitions. In this age when there are reports that USCIS is sending out invistigators to look into even ac21 cases you are misleading people into porting from eb3 to eb2. Forget about porting as no one is even sponsoring eb3 perm.
As slim a chance as it is, visa recapture or some administrative fix like a remporary green card or relaxation of ac21 regulations like same semilar job restrictions is our best bet.
Eb2 will be better most of the time because many will not be eligible or Job position does not need Masters or 5 years of experience. So it will move fast though it may go back on october. So if possible try to port into EB2 will always be a good idea. CIR or Visa capture bill may not be possible atleast for an year or more. EB1 and EB2 are best bet for next 1 to 2 years.

i concur with the aspect of filling a lawsuit, as it will create more visibility and put more pressure on congress. As it is congress is under the gun for failing to act on a lot of bills. Even though if it does not create instant results, it will definitely lead to some type of change in coming months. I am sure if we all pitch in 50$ each, we can accumulate good amount of money. Also we can use Murthy Law firm to file a lawsuit. Lets not forget the amount of visibility Murthy law firm is getting from IV. If there is a law suite filed through them, then they also get to share the limelight.
The point here is, we can get a discounted price on the service, also Murthy law firm is aware of our situation. Administrator what do you think?

That validates my reply previously to a posting by a guy who said that he had called up TSC and they said they go by RD...I had asked him to call back after a day and he'd get totally opposite info.
My situation is the same.....I was TSC-CSC-TSC....but I had received an RFE last year.....dunno why will they preadjudicate and then go by ND which is totally non-sense...logic should be that if a case is preadjudicated it should be put on based on PD..
Again USCIS don't follow any logic...
As I said b4 very few transfer cases will ever get approved.....just bid your time...or apply thru EB1 chances are better that way..

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question. Lets talk about passing the baton, how about we start from posting your phone number on the website, lets see how you take that challenge. No one is paid to work on IV. People spend time on this effort out of their good-will and passion for the cause. So please be respectful towards others for their efforts. And please stop being a pain in the neck and talk some sense if you are serious about picking up the baton. Email us your phone number and you will see it on the website within an hour.
Now its time for you to go to all the forums of the world and say that IV Admin is rude and dictatorial or whatever.

I am a beneficiary of the GC process , my husband being the primary applicant.
Applied for 485 in 2002.So now i am in the "pending immigrant" category.
I attend a top Medical school and expect to be offered a Leadership TrainingGrant under the Bush's no child left behind program to serve US citizen/residents children/infants.
As this package comes with a payback ie need to serve the country/citizens anywhere in the world for 2 yrs post graduation i need to evaluate my options. I take this grant and move away without payback it will be fraud or i will have to payback 80K!!!( tuition etc)
With the GC in limbo and not sure what will happen I will be forced to reject this offer!! I will get full scholarship from elsewhere so i aint worried about it.. but this country has missed out on my services due to the delay in GC.
Currently i am assigned in the Veterans Affairs and treat soldiers from Iraq and other places, also I am expecting to take up a position in VA post graduation (ie only if I get GC!!/Citizenship.. which could i could have if the GC were to be processed in 1-1/5 yrs and post that 5 yrs would be the time of my graduation) Again this country is loosing.

I was the one who DID NOT send any flowers because I was simply scared.

I was the one who wouldn't do rally, simply I did not think it's gonna work.
Now, I am very happy. At the same time, I shame myself.
Once again, I bow to all members who actually did something & contributed something to this community and entire legal immigrants. I will remember this day even when I get a citizenship in the future.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.
Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.
I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. There is no magic wand! Last time around, there are lot of cases in preadjucated state, So, they were able to approve in thousands. This time, most cases they did not touch till now. That makes it difficult to expect lot of approvals.

In the bad economy if everyone can get EAD it will help more. All we need is an admin fix to allow filing of I485 and get EAD benefits

I can debate you rationally under one condition; the moment you resort to personal attacks I will stop. I will assume you have a fair grip of English language and decent comprehension skills. If you agree then lets get this rolling:

If you did, then I hope you will stop making simplistic comparisons of Mexicans coming into US to lets say Bangladeshi's coming into India.

What you are making is called a straw man argument (Straw man - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Strawman)). In this case, the woman is NOT a terrorist nor
was she suspected of any such crime, so bringing such hypotheticals will not give any weight to your argument.
What you are seeing is a case of 'socio-economic' osmosis. Problems of this nature has been debated across many nations of the world. How you handle these issues goes to the core character of the nation. Shooting 'intruders' is perhaps one way of looking at it. Then such a solution cannot be undertaken by a 'super-power' who wants to hold moral superiority in the league of nations.
A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? Please do not give a flippant reply, do think about it before you hit the submit button.
Socio-economic solution along with a sensible immigration policy has been found to be far more sensible as compared to a pure enforcement policy. It has been proved over the years that a pure enforcement policy which many nativists support to be economically unviable. Minutemen patrolling the borders to Gov. Perry's multi million dollar border cameras, have proven to be ineffective and economically unfeasible.

People we have a question, throw us some light now that our application officailly falls under current dates....
Our service center is Texas Center and the dates -
Priority Date - Oct 18 2004
485 Received Date - Aug 17th 2007
485 Notice Date - Oct 16th 2007
The current processing time for Texas Service Center is August 23rd 2007. Do they process based on reciept date or notice date? From the past experience we know that they donot process based on priority dates (We have been current for 3 times in the past and saw approvals for PD's in 2006 with earlier notice and receipt dates)
I called uscis a couple of weeks agoand again today, I was told (by two different resp) that they go by Receipt date.
