I have started the process where my employer is working on the filing. Of course they keep reminding me that EB1 is retrogressed and so I cannot file concurrently. Sunil is right if you mean "actual filing" as the process having started. As for me I am dithering because once I file I will have to sit tight for the whole thing to end and right now there is no end in sight. If I change jobs after filing I will have to go through this whole pain again! Hope this clarifies the situation. Let me know if I can be of any help.

    Jay,
You never cease to amaze me, impress me, and educate me.

You have taught me that this goes beyond just getting our green cards.

This is the difference between people that succeed in life and people that don't, people that bring change to the world and people that sit around hoping the world will change for them.

In you, and many others on IV, I see that kind of drive and motivation, and I hope to absorb some of that positive energy.

At times I have wondered why I do this, when most people that I know, who are in a similar situation don't. But I have always come out of that thought process with nothing but reaffirmation of my actions, and the intent to continue doing what I do, thanks to IV members like yourself.

I might get my green card in another year or so, but seeing the unwavering motivation and passion with which some people continue to challenge and change things that aren't right, makes me want to continue doing whatever little or large I can, to help them (and help myself in the process!).

My next destination after this thread, was this one.

    I will contribute $25.

How to contribute? I have a regular payment going out to IV. How to ensure this one goes to this separate bucket and not mixed with the general contributions.

If this has been discussed in the middle of this thread - please consider updating the first post with the info so that we don't have to dig through pages of discussions to find it.

    Puddonhead,

I am still in process of finalizing how to collect money for this. I and Pappu are discussing possible solutions and will come out with something soon.

Please vote above to pledge. I will go through this list once account is created to follow up.

    Folks,

Thank you for your patience. Here is a short piece I wrote that I will be emailing to digital2k. In the meantime, I am posting it here for your FEEDBACK AND PERUSAL.

Please DO SOME FACT CHECKING for me .. for example, the dates, time frames, etc.

    Thanks!

Around the second week of each month, a welter of activity breaks out on the online forums of Immigration Voice, a non-profit organization set up by employment-based legal immigrants in the US. Users on the site vie with each other to predict the cut-off dates for the next months Visa Bulletin. These dates dictate the hopes and lives of thousands of legal immigrants and owing to their sheer numbers, Indian and Chinese applicants make up the overwhelming majority of those who wait in line for employment-based US permanent residence.
Since 200x, barring a few anomalous months, the cut-off dates have largely languished between 2003 and 2004. While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
    1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
    2) Lack of transparency throughout the process.
    3) Lack of customer service in spite of regular ramping up of immigration fees.
    4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
    5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCISs faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. That the United States, the most advanced country in economic and military leagues, cant account for its legal immigrants speaks to the need for more highly-skilled immigrants to improve the status quo?

I have given my phone number several times, even you can have it ( 412 915 9526 ) but the admin is not willing to call me. I believe GCStatus has sent his phone number too. I have been a member here since July 2007, based on the GCStatus credentials, he has created his ID just a month or so. Why would I all of a sudden fake my ID when I have such a good reputation in this site. You can visit all my posts.

I hope you got convinced. If yes, please talk to our super Admin.

    Thanks

Are you guys anonymous? Why is the admin asking for your phone number? Didn't you fill in your actual name, phone number to reach you in case IV needs your help.

You have to be willing to help if you want to lead.

You have become a citizen. What is your vested interest in pursuing this divisive discussion ?

Stay away from IV. We don't need your inputs here.

    Admins,

number30 is likely an anti-immigrant. Please ban him.

I completely agree, I am suspicious about true intentions of Number30.

Yes when you leave the country you are in status again! for i-485 AOS, USCIS will look at your status since your LAST entry into the country

Ok, so if I file the i-140/i-485 now and leave/re-enter the country with a new stamp. Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because by the time they are looking at the AOS application, I have already left and returned to the country??

Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!

Thanks man. My decision was mainly based on the waiting period. Within 4-5 years I can get ultimate post based on my experiance at india but here I have to be in same role.
Also I am trying to start my own IT training firm there so with gods on my side in 4-5 years that company can grow to a mid size firm.

Gaurav, may I know how many years of exp do you have?

    Ragz4u:
I am sure guidelines for the stories are buried deep and scattered in the thread. For the benefit of all and a good story line for publication in this top US publication, could you once again summarize in bulleted points you are looking for. In the meanwhile, I will research this thread and come up something similar. Also, this will keep this thread in focus. Thanks.
    We need

    1) More stories, preferably non IT or IT if it involves research. Please look at the first post in this thread for the format of the email.

    2) All those who have sent stories in the past to me, please send us your phone numbers where we can call you and also our IV id. We might call you very soon.

Such opportunities do not come often...we can really be noticed Nationally if we are successful this time and it will help our cause immensely....please help yourselves....

Not sure about the news, but based on my and our experiences with uscis,I have to say these two IO are EXCEPTIONALLY friendly. You can casually walk up to an IO after taking fingerprint? I thought you would be arrested if you go to any uscis office after taking the finger print. You will receive call from IO to give missing material? I suppose there is something called "RFE", and they are never afraid to use RFE, even for most minor and unnecessary reasons. Gee, if only half of the IO are good as this, there will not be any immigration problem anymore.
Today we've received Two Sensational News About VISA# consumed.

    1) CableChing visiting ASC And IO informing him about Circular

She showed me DOS Memo she just received about no more visas for India/China EB2 for this fiscal year. She did infoact show us the memo.

She did check mine and my wife's Name Check. Luckily our name check is cleared and she told we have to just wait for the visa numbers.

    I dont think so, my friend gave me this information - i am not sure its reliable or not;

One of my friend received a call from IO Adjucating officer yesterday
and it seems adjucating officer asked him to hurry up to send his wife's medicals because
there were only 14K more visa numbers left as he did not include his wife's medicals (she was pregnant when they were filing I-485).
He received his approval notice but not his wife's due to the missing medicals

so relax guys - there could be atleast 13k visa numbers left.

Two Sensational News Which one is true?
Cableching says VISA# reached numerical limit and chintainfogc's friend said 14K / 13K VISA left.

    Hi Everybody,

I would like to start this thread for the benefit of people who do not have a straightforward immigration history. In a nutshell, I hope in the future this thread will serve to provide information and advice on

Out of Status issues - Inconsistency with what's stamped in the passport and what you're actually doing
Unlawful Stay - Stay beyond the date in the I-94 card

The main focus will be on what these things can do to your i) AOS/CP filings ;and/or ii) future non-immigrant visas.

I came to this country because of a twist of fate and had zero knowledge of the immigration laws here. Through the school of hard knocks, I have gained considerable knowledge about this convoluted process that affects us all and hopefully what I learnt will be of use to other people in the same boat.

A special mention goes out to "unitednations" for his skill and knowledge about various issues. Thanks buddy, you're a huge asset to all of us.

    Dude ,

You been thru a lot and looks like you still have some sanity left in you. Keep up the good spirit ... Good luck with your 485 ...:)

    Hi,

I read a posts by you all on immigration voice which said U.S newspapers can easily publish a name change Ad for $70!! But I hear that they need some kind of a court order to do that...Can I ask you which paper did you advertize in India and in U.S. I have the same problem as many others -- I have only one name on my passport "Kritee" and U.S. embassy when they gave me visa made it FNU (as first name) Kritee (last name). Now I want to add a first name to my passport and all documents in U.S...and am wondering if I need to go to a U.S. court or not? All and any help will be appreciated!

    Thanks.
    Kritee

Hi, did you find out? please post I need this info too.

I would suggest you ask your father to file a writ petition in High Court or Lower Court , my husband did the same for a minor change in his father's middle name.I presume you are indian and Indian authorities have not changed they require a beat down in court then only they work that's my firm belief. In our case it was a simple case my father in laws middle name was misspelt, we had all the evidence they required
    school leaving,college leaving,birth certificate,PAN card.
Passport of my father in law where my husband travelled as minor.
Plus we got a letter from District Magistrate/Collector
But still Washington embassy would not budge or entertain our application saying this mistake was not by them and i approach passport authorities in india who had done this .
Finally my husband had enough and my father in law filed a petition in Lower court ,it took a couple of months to get the facts straight ,but it was quicker than we expected. Got a court order attched to application got the correction done.
the problem is we dont approach the law thinking it is headache but the fact is that the issues was not corrected at the right time so we will have get the facts verified by someone credible and who better than law to verify.
And the plus is that no one can refuse your appication and give u the run around ( that you are facing now get this doc get that doc)
as if the consulate does not follow the order it is contempt of court or they can file an appeal against the order . My suggestion would be to go thru courts because the procedures for changes are not crystal clear

but my case is different as i dont have any spe;lings or wrong name.
i need my name to be split in to first name and last name.
