This is very nice, but lets not make it EB2 India specific, other EB2 and EB3 has the very same issues. Let make it a bit more generic so that everyone can participate. 100 letters would not achieve anything 1000 would surely make a difference.

We need to act on this sooner rather than later .. how about the interested few of us do a conference call on skype or yahoo this weekend?
One idea: In addition to this letter and Bawa's posters, we could enclose the list of the historical EB2 visa bulletin dates that you painstakingly drew up on the other thread? Could you post it here?

I had the exact same question. If one responds to an RFE on his/her I-485 app, is there no place on the online status description where we can find the original receipt date?
Also, can one assume that his/her case has is pre-adjudicated, if there are no further requests from USCIS after an RFE reponse from the applicant?

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.
Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.

I googled to find any cases similar to the one I have now, by no luck.
My wife was out of status for more than 6 months while she was on H1-b by not working. To put her back on status, my attorney advised to make her go out of the country and come back on H4 visa. Her status now is H4 and has maintained it since the last entry to US. I have maintained my H1-B status since 3 years and got paid for every day.
Is it possible, my I-485 is approved (primary applicant) and her I-485 denied (dependent) due to her prior out-of-status on H1-B? Her current status as mentioned in the I-485 forms is H4.
Please advice.

I would not lose sleep over it. Since, she left and re-entered the country her "clock" gets reset. She should be ok. Just be truthful on the forms so that they can't nail you guys later.

I respect the efforts done by IV for whole community to come out of this real time problem.
inthe begening people were saying something about IV updates as it appears to be false but IV proved that they were right and accurate and I think that makes community to trust IV.

Thats True, I see that too that people doesnot seems to be enthusiastic, may be because of the reason that many members have left after getting their GC.
and are not intersted in this effort any more.

If the authorities were really clever they should have accepted the 65000 with highest salaries instead of doing something random like a lottery. This in turn would have forced employers to raise wages to have a meaningful shot at getting a visa.

As per one of the patrons on another thread an IO showed him a memo recieved by USCIS suggesting that all Visa numbers for EB2 India/China were exhausted

So, basically if I get a new I-94, am I in status again? Someone mentioned that you should be in status since your last arrival to the US. That was in 2004. So, i was under teh impression that I had to leave the country and return and things would be OK.

Yes when you leave the country you are in status again! for i-485 AOS, USCIS will look at your status since your LAST entry into the country
