I need to add my daughter's last name to I-485 and subsequent AP. Do I still need to have US court order for doing the same once her passport has correct last name ? How much time does the US court order take and what is the cost ?
Please share if anyone have experience adding the last name with USCIS and how long does it take ?
Look for Name Change document in your local county court. This is fairly quick process and one can use court order indicating name change to update name change in passport and all pending applications at USCIS.
You may need new visa stamp indicating new name.

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

Has Oct bulletin traditionally gone forward than Sept bulletin. I feel very bad for EB3. Oct has to open up for EB3.

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item

You can do that and IV (core or its members) will not bite at you, because we know we are all part of the same movement, with the same frustrations, pain and stress associated with uncertainty. What is really needed is channelling the frustration toward action, mobilization and support at the grass roots.
The opposition is strong. But if we are to succeed, we need to work together. IV work is not easy. Takes time, commitment and money. Lots of people have been trying to do it for a long long time now. But circumstances and uncertainty/unpredictability associated with the legislature and governmental agency(ies) have always been the deterrent for IV's success.
Reversal of July 07 VB, multi-year EAD, Extended OPT etc. - IV has played significant roles. Under tough circumstances, IV has been able to obtain temporary measures that provide interim relief to you and posterity.
The day will come when retrogression will become history. But nobody knows what the calendar date of that day is. I surely hope that the day falls in 2008.
As a start, have you looked at the High-Five campaign started by a IV member? Please donate $5 for that campaign. That is the least you can do.

Can someone advice on this.
Currently I am on H1B visa and I will apply my AOS before 17th august as dependent(Secondary applicant).
After applying AOS if I have to leave my job then will I be out of status since I won't be on H1 status and I won't be on H4 ?
Can I leave my job after applying AOS or I have to wait till We get receipts of 485?

You will be in "pending adjustment" status as a dependent, but since you're not on a H4 I am not sure what may be in store. Check with a good lawyer.

Has anyone got an idea of unused visas from EB1 and ROW EB2?
It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.
Which category does the unused/overflow visas go?
None of the lawyers I emailed have an answer (they like this retrogression btw more $).
USCIS doesn't care if a non citizen asks a question.

I am going to re-iterate, for I firmly believe I owe my ability to file AOS to this organization!
If you too saved thousands of dollars owing to the VB reversal... this is the least you can and should do to help yourself to a GC, a few years sooner than otherwise.

We don't want to create more divisions based on how they got in to queue for GC. As a matter of fact, my company filed I-140 based on a old labor, where the skills were matching exactly and the previous person left the company. The company that I work in has 8500 employees, I was not even aware that they filed premium for I-140. I did not have to pay dime for all the process.
Pls remember filing substitution labor was legal back then.
However, USCIS removed this provision in 2007 and the discussion ends there.
When you compare all other issues that are the root causes for the retrogression, we are spending the time and energy on some thing that would not help any one.

I hope your final version will correct the addressing to the members of congress.
Please avoid using "Dear Zoe Lofgren" kind of addressing. More appropriate would be "Honorable congressman/woman XXXXXX"

People we have a question, throw us some light now that our application officailly falls under current dates....
Our service center is Texas Center and the dates -
Priority Date - Oct 18 2004
485 Received Date - Aug 17th 2007
485 Notice Date - Oct 16th 2007
The current processing time for Texas Service Center is August 23rd 2007. Do they process based on reciept date or notice date? From the past experience we know that they donot process based on priority dates (We have been current for 3 times in the past and saw approvals for PD's in 2006 with earlier notice and receipt dates)
I called uscis a couple of weeks agoand again today, I was told (by two different resp) that they go by Receipt date.
