USCIS has done what britisher's did "DIVIDE AND RULE".
They have divided the whole GC process into various categories already.
First it is Employment/Family/lottery.
Then it is eb1/2/3 and so on
Then it is country wise quota.
I mostly see people from categories eb 2 and 3 fight over this issue.

Please do not start a new category "SUBSTITUTED LABOR" .................no one wants anyone ahead of him and same applies to me as well.

Probably he explained in a much better way than i' d have explained. Spent 7 years on H1B, caught up in retrogression. I specialize in what is called as Rational Unified Process,train and mentor the application development teams.I've worked for a telecom company (one of the top 3 in USA), got laid off, started the journey again. Presently working for another frontline Financial Services company in the world. Recently, some of my work (with my permission) was included as a practical example for students in an university in St.Louis. however, i was not allowed to teach because of my legal status and constraints of H1B.
Even though it's painful to me, it's much more loss to the students who otherwise would have learned something valuable and make a difference in their careers
As a matter of fact, one of my colleague also applied in the same day, same attorney, same EB3, working for the same telecom company with exactly same designation but applied from Missouri, where as mine was applied in Kansas. He got his green card inspite of the layoffs, where my LC was not approved till today. (in 2002, some cases filed in MO were approved much quicker compared to Kansas) A classical example of how there is no justice &the current system is broken

While I understand a green card is not my right, I think I have worked towards it for a long time now. I am in this country legally, paying taxes, contributing to this economy, spending my earnings in this country like any other law abiding American citizen.
I have legally asked this country and USCIS for Permanent Residency (PR). My request for PR is not based on the premise that my parents/relatives live here and are citizens in this country. I am not even asking for Permanent Residency because of the country I come from. I am asking for Permanent Residency based entirely on my educational qualifications, professional expertise and the demonstrated contributions I have made to businesses and the American way of Life.
I have also been accepted as an Instructor at a reputed University in California where I will be teaching in my area of expertise. This clearly helps the American society and Industry.
When I moved to the US, I believed America is all about meritocracy. Work hard, prove your worth and you get what you truly deserve. I feel six years is enough time to prove your worth to get a Permanent Residency.
My tax returns, my legal Status documents, my contributions to this economy etc will prove it. What is really disconcerting is the fact that, now I have to continue to wait for I don't know how many more years for USCIS to even look at my credentials, let alone give me an up or down decision. Mind you this wait is not because of any delays attributable to me.
Is this fair ?
If you think you don't need me, at least tell me, in a reasonable period of time. Please do not make me wait indefinitely.

The only reason i got worried was that a friend applied on the 23rd and got hers yesterday. We both applied in the same center too.
I just hope that paperwork is there and hasent been lost or something.

Though I am cynical about this campaign, I appreciate your efforts to do some good. The reason I am cynical is because any campaign with a small set of beneficiaries or members has a little chance. And more importantly such operational mistakes are hard to prove and stand little chance for correction as these are time bound actions and you cannot go back in time and rectify them. However, these are just my views!!!
But I am noticing that you have 2 reds against your posts. We can disagree with each other but we cannot undermine the sincere efforts and let anti immigration folks have a laugh at us.

I totally agree with your idea and am sure that it would be great relief for all of us. But USCIS is so lazy that they do adjudicate cases which have their priority dates as "current". It would be a miracle if they really adjudicate all cases even if the visa number is not available. I think we should also push for a system where USCIS should release the total number of cases adjudicated on a weekly/monthly basis so that the process is transparent and we can see how much work they do.
I hope they pre-adjudicate all our cases and end our miseries.

If HR 5882 bill is passed, it is good that we have more visa numbers. But the issue of random processing without considering priority dates is frustrating to people with older PDs. Lot of people here are eligible to get GCs with the current cutoff dates, but still are being left out. I think, this is another very important issue to be fight for by the IV core team and members.

As I read the thread above on the perennial point of contention PD or RD or ND.
My question to the forum is how can TSC (My case was filed at TSC) sent an RFE if the case is not opened....I received an RFE in Nov of 2008...my 485 RD was July 23rd 2007 and ND was Sept 5 th 2007.
The RFE was responded to....now I was surely out of the ND window last year and technically an IO shouldn't have opened my file...but apparently he did...
Since I was contacting my local congressman and Senators...I got this feedback that my case is pre-adjudicated but waiting to have a visa number available....but I don't know who to trust...I am just not very hopeful and if 485 ND is the date they go by I have no chance and will miss this opportunity too.

I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.
While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

This notice is in reference to form 1-539, application for Extend/Change of Nonimmigrant Status, requesting a change of status to that of a dependent of a specialty occupation worker under section 101(a)(15)(H)(i)(b) of the Immigrantion and Nationality Act.
It is ordered by the Director of the California service center, United States Citizenship and Immigration Sevices that the applicant's request for change of status be denied for the following reasons:
As a dependent, the applicant's classification is subject to the principal alien's status. The nonimmigrant visa petition filed in behalf of the principal alien, seeking a concurrent change of status to a specialty occupation worker classification under 101(a)(15)(H)(i)(b) of the Act, has been processed as a consulate notification because the principal alien's request for a change of nonimmigrant status has been den ied.
Since the principal will not be classified as a temporary nonimmgrant worker until she/he obtains the HI-B visa abroad at a United States Embassy or consulate, and has been lawfully admitted into the United States in the nonimmigrant status, the applicant does not qualify for the requested change of status.
I have not received any information about mine. Does it mean that my application will be processed at a consulate office outside the state? I am confused. I do not really understand it well. Please help explain it to me.

pappu, pls let me know, if u received the fund. Also, one small suggestion, we can just maintain a small excel sheet, to just see who (just the user id and not the actual name) contributed and how much money they contributed just in this campaign. Cos, I hate to say this, I just dont want to be around those who want to have a free ride from all the hard work that IV group is putting in. Please everyone please donate. If you are reading this post, if you have not contributed earlier, please contribute. Dont you want IV to become strong financially when fighting this tough case. They need all the help they can get.
